The plaintiffs claim the doctor left the hospital for several hours and showed up late to perform a cesarean section birth. Allegedly, the physician saw the mother at 11 a.m. and did not return until 9 p.m.
According to the lawsuit, the doctor failed to timely deliver the baby, used inappropriate tugging during the delivery and failed to deliver the baby without trauma. The parents claim that, due to the doctor’s negligence, their daughter now suffers from cerebral palsy and will require constant medical care for the rest of her life. Reportedly, the lawsuit was recently settled, with the defendants agreeing to pay the family nearly $35 million.
