Family of injured boy receives $120 million in lawsuit

The birth of a child should be a memorable moment filled with wonder and joy for parents in Tennessee. Delivering a baby is also a fragile and delicate process. If medical providers make even the slightest error, it could mean drastic consequences for both the infant and mother. Tragically, hundreds of babies suffer birth injuries every year as a result of medical malpractice. 

Lawsuit filed 

In another state, a medical malpractice lawsuit was filed by the family of a boy who was injured during birth. The mother said she was at term but not near delivery when she arrived at the hospital. Sometime after the mother was admitted, the fetal monitor indicated non-reassuring fetal heart tones. A Cesarean section was ordered. 

The lawsuit alleged that the non-reassuring heart tones were a call to urgency. Yet, according to the lawsuit, the C-section was delayed nearly two hours. The plaintiffs alleged this caused their infant boy to suffer severe asphyxiation, which resulted in him suffering permanent brain damage and cerebral palsy. Reportedly, a jury sided with the plaintiffs and awarded them $120 million in damages.
